Problem being addressed
The Airports Regulations 1997 and Airports (Ownership-Interests in Shares) Regulations 1996 sunset on 1 April 2024, so will be automatically repealed if no government action is taken to replace them by that date.  If they are allowed to sunset, the Commonwealth regulation of activities and industry participants for 22 leased federal airports in Australia would be disrupted, creating uncertainty and potential safety, environmental and other impacts.

Proposal
To remake the Airports Regulations 1997 and Airports (Ownership-Interests in Shares) Regulations 1996 with minor updates to the regulations including: 

  • Adjustments to reporting requirements relating to ownership and control of airport-operator companies.
  • Streamlining of sublease and licence requirements – maintaining regulatory requirements in the form of prohibited kinds of subleases and licences, but removing the step for regulated entities to apply for approval of these.
  • Some consolidation of thematically similar regulations in one instrument, which will help regulated entities and the public to better navigate these regulations and the regulatory obligations contained in them.

Consistent with the Government's Policy Impact Analysis requirements for sunsetting instruments, the Department has, after consultation with stakeholders, assessed the instruments are operating effectively and efficiently.
