Problem being addressed
The Social Security (Personal Care Support – Victorian Transport Accident Commission – Scheme for Payment of Medical and Like Benefits to Persons Injured as a result of a Transport Accident and Scheme for Individualised Funding) Determination 2015 (the determination) was made under section 35A of the Social Security Act 1991 (Cth) to ensure that personal care support payments made to transport accident victims are exempt from the income test used to determine an individual’s entitlement to a social security payment.

The determination was due to sunset on 1 October 2025.

Proposal
The Department of Social Services proposed to remake the determination by way of a new legislative instrument without significant amendments. The new instrument is Social Security (Personal Care Support)(Victorian Transport Accident Compensation Scheme) Determination 2025

Assessment comments
Consistent with the Government's Policy Impact Analysis requirements for sunsetting instruments, the Department of Social Services has certified that the determination is operating effectively and efficiently. Therefore, an Impact Analysis is not required for the remaking of the instrument.  

Regulatory burden
The Department of Social Services estimates nil average annual regulatory costs to people, business or community organisations.
