Apparatus and broadcasting licence condition determinations

Problem being addresses
The Radiocommunications Licence Conditions (Temporary Community Broadcasting Licence) Determination 2015 (TCBL Determination 2015) and Radiocommunications Licence Conditions (Broadcasting Licence) Determination 2015 (Broadcasting Determination 2015) are due to sunset on 1 April 2025 and 1 October 2025, respectively. The TCBL Determination 2015 allows the Australian Communications and Media Authority (ACMA) to determine the conditions applicable to temporary community broadcasting services. The Broadcasting Determination 2015 allows the ACMA to determine the conditions of particular types of apparatus (such as transmitter) licences.

Proposal
The ACMA has remade the Broadcasting Determination 2015 and TCBL Determination 2015, and combined them into a single instrument that will perform the current functions of both determinations.  The instrument will otherwise be remade with only minor changes.

Sunsetting Instrument

Assessment comments
Consistent with the Government's Policy Impact Analysis requirements for sunsetting instruments, ACMA has certified that the regulations are operating effectively and efficiently. Therefore, an Impact Analysis is not required for the remaking of the regulations.

Regulatory burden
ACMA estimates no change in the average annual regulatory costs burden to people, business or community organisations.
