Income Tax Assessment (1936 Act) Regulations 2025

Problem being addressed

The Income Tax Assessment (1936 Act) Regulation 2015 (the Regulation) prescribes how certain parts of the Income Tax Assessment Act 1936 are to be implemented, including determining the amount of the tax rebate available for seniors and pensioners, and specifying the Australian Defence Force (ADF) operations for which the pay and allowances of members of the ADF are exempt from income tax.

The Treasury notes that under the Legislation Act 2003 (the Regulation) is scheduled to sunset on 1 October 2025.

Proposal

The Treasury remake the Regulation without significant amendment.

Assessment comments

Consistent with the Government's Policy Impact Analysis requirements for sunsetting instruments, Treasury certified that the Regulation is operating effectively and efficiently in lieu of preparing an Impact Analysis for remaking the Regulation. This assessment has been informed by a public consultation process, and targeted consultation undertaken with the regulator, the Australian Taxation Office.

Regulatory burden

The Treasury advises there will be no change in regulatory costs.
