Problem being addressed
The ability to undertake explosives handling activities, including transport in a safe and secure manner, is essential for fulfilling the unique operational requirements of Commonwealth Government Agencies including the Department of Defence (Defence), the Australian Border Force, the Australian Federal Police, and numerous contractors acting on the behalf of Commonwealth agencies. Both the Explosives Transport Regulations 2002 and the Explosives Areas Regulations 2003  (the regulations) are due to sunset on 1 October 2024.  

Proposal
Consolidate and remake the regulations into a single modernised legislative instrument, other minor amendments to correct out of date references and web links, and ensuring currency with the List of Authorised Commonwealth Explosives.

Assessed Impact Analysis outcome
Sunsetting regulations.

Assessment comments
Consistent with the Government's requirements for Sunsetting Legislative Instruments, Defence has consulted affected stakeholders and certified that the regulations are operating effectively and efficiently. This certification and self-assessment by Defence been used in lieu of an Impact Analysis for remaking the regulations.

Regulatory burden
Defence has indicated no change in regulatory burden are anticipated.
