Problem being addressed
The Corporations (Derivatives) Determination 2013 (the instrument) sets out the classes of derivatives which are subject to the Australian Securities and Investments Commission’s derivative transaction reporting and clearing rules. This instrument and the rules that it enlivens, are a key part of Australia’s regulatory framework for derivatives, introduced in line with G20 recommendations following the global financial crisis. The instrument sunsets on 1 October 2023

Treasury propose to remake the instrument without amendments.

Sunsetting instrument 

Assessment comments
Consistent with the Government's Policy Impact Analysis requirements for sunsetting legislation, the Treasury has certified that the instrument is operating effectively and efficiently. Therefore, an Impact Analysis is not required for the remaking of the instrument.

Regulatory burden
No change in regulatory costs.
