Remaking of sunsetting instrument without amendments – Department of Health

The Therapeutic Goods Administration (TGA) of the Department of Health remade the Therapeutic Goods Advertising Code 2007 as the Therapeutic Goods Advertising Code 2015 on 9 November 2015. The Code sets out the principles and minimum requirements for the advertising of specified therapeutic goods to the public, and complements the advertising requirements in the Therapeutic Goods Act 1989. In line with the Australian Government best practice regulation requirements for sunsetting legislative instruments, the TGA has assessed the operation of the instrument in consultation with representatives of affected stakeholders and has certified that the instrument is operating efficiently and effectively. Therefore the Office of Best Practice Regulation notes that a Regulation Impact Statement is not required for the regulation to be remade. The instrument was remade without significant amendments and there are no changes to compliance costs.
