Problem being addressed
The Customs (Prohibited Exports) Regulations 1958, specifically the Australian Domestic Gas Security Mechanism (ADGSM), were scheduled to sunset on 1 January 2023, as per the Legislation Act 2003

Proposal
The Department of Industry, Science and Resources (DISR) certifies that Customs (Prohibited Exports) Regulations 1958, specifically the ADGSM, is operating effectively and efficiently, and that therefore a Regulation Impact Statement is not required for this regulation to be remade. 

 The assessment that the regulation is operating effectively and efficiently has been informed by DISR's routine engagement with industry, including ongoing dialogue with individual LNG facility operators and the industry peak body, the Australian Petroleum Production and Exploration Association.

This remaking process was followed by additional changes made to the ADGSM separate to this assessment process which triggered the requirement of a fulsome Impact Analysis. Assessment comments
Consistent with the Government's Policy Impact Analysis requirements for sunsetting regulations, the DISR has certified that the ADGSM regulations were renewed and are operating effectively and efficiently.
