Remaking of Sunsetting Instrument Without Significant Amendments

Deemed Diseases Legislative Instrument (the ‘Deemed Diseases List’) for the Safety, Rehabilitation and Compensation Act 1988 (SRC Act) – Department of Employment

On 1 October 2017, the above legislative instrument was scheduled to sunset. However the Department of Employment has decided to remake the instrument  as the Safety, Rehabilitation and Compensation (Specified Diseases and Employment) Instrument 2017, with minor amendments.

The SRC Act provides workers’ compensation coverage under the Commonwealth workers’ compensation scheme (Comcare Scheme). For most work-related injuries there is a clear link between the injury and work. By contrast, for some diseases it can be difficult to prove that a disease was caused by a particular work-related exposure.The Deemed Diseases List contains a list of diseases which are deemed to be caused by employment if the relevant work-related exposure can be established.

The Department of Employment, after consultation, has remade the instrument with minor amendments to improve its effectiveness and efficiency to ensure it remains fit-for-purpose. Therefore, a Regulation Impact Statement is not required for remaking this instrument without significant amendments.
