Remaking sunsetting Higher Education Provider Guidelines 2012

Problem being addressed
The current Higher Education Provider Guidelines 2012 will sunset on 1 April 2023.

Proposal
Proposal is to remake the Higher Education Provider Guidelines 2012 under section 238-10 of the Higher Education Support Act 2003 and make the following procedural and administrative changes:

  • Specify further circumstances as to when a provider defaults in relation to a student and providing an exception where a student was unable to enrol in any units of study because of the student's personal circumstances.
  • Require additional matters that the Higher Education Tuition Protection Director must include in its written notice to a student where a suitable replacement course is available.
  • Updates to the minimum indicative course fees for overseas students.
  • Updates to the requirements for financial statements that higher education providers must give to the Minister.
  • Updates to the matters that the Minister must have regard to when determining the financial viability of a higher education provider under Division 19 of the Act.

Assessment comments

Consistent with the Government's Policy Impact Analysis requirements for sunsetting instruments, the Department has, after consultation with stakeholders, assessed the standards are operating effectively and efficiently. Therefore, an Impact Analysis is not required for the remaking of the standards.

Regulatory burden

No change in regulatory costs.
