Problem being addressed
The Product Stewardship (Oil) Regulations 2000 (Regulations) and Product Stewardship (Oil) Declaration 2003 (Declaration) were due to sunset on 1 October 2022. The Regulations and Declaration form part of the legislative framework that allows the administration of Product Stewardship for Oil Program established under the Product Stewardship (Oil) Act 2000 (Act). 

The Act was introduced to establish a levy-benefit scheme arrangement with the aim of increasing recycling of petroleum-based and synthetic waste oil in Australia. The Regulations provides rates of benefits and standards for each category of recycled oil. The Declaration sets out the gazetted oils that can be used and the gazetted uses to which they can be put, to claim a benefit under the scheme established by the Act. Without these instruments being remade, recyclers and re-refiners of waste oil will no longer be entitled to scheme benefits. There is a risk of fall-off in collections of waste oil, with the potential for causing environmental harm.

Proposal
The then Department of Agriculture, Water and the Environment (DAWE) (now Department of Climate Change, Energy, the Environment and Water, DCCEEW) remade the Regulations and Declaration.

Assessment comments
Consistent with the Government's Policy Impact Analysis requirements for sunsetting instruments, then DAWE (now DCCEEW) has certified that these instruments are operating effectively and efficiently. This was informed by an independent review of the 2021 Product Stewardship (Oil) Act 2000 (Fourth independent review of the Product Stewardship (Oil) Act 2000 - DCCEEW).
