In November 2011, the Standing Council on Transport and Infrastructure (SCOTI) approved legislation to introduce National Rail Safety Laws and to establish a single National Rail Safety Regulator for Australia. The National Rail Safety Law included requirements relating to fatigue risk management. At the time, it was determined that the issue of whether the National Law should further regulate hours of work and rest for rail safety workers required further consideration. On 18 May 2012, SCOTI announced that in all states and territories hours of work and rest will be regulated under the existing framework of the National Law, although New South Wales will retain its current prescribed train driver hour limits. A further review of fatigue arrangements will be undertaken by the National Rail Safety Regulator within three years of the commencement date of the National Regulator. The Regulation Impact Statement was prepared by the National Transport Council and has been assessed as adequate by the Office of Best Practice Regulation.
