Participant Derogation- Financeability of ISP Projects – TransGrid and ElectraNet

On 1 October 2020, the Australian Energy Market Commission (AEMC) received separate rule change requests from TransGrid and ElectraNet seeking participant derogations from the applicability of the rules in relation to the financeability of their share of actionable Integrated System Plan (ISP) projects.

On 4 February 2021, the AEMC released the draft rule determinations titled National Electricity Amendment (Participation Derogation- Financeability of ISP Projects (Transgrid)) Rule 2021 and National Electricity Amendment (Participation Derogation- Financeability of ISP Projects (ElectraNet)) Rule 2021. The AEMC has determined in both cases not to make the proposed derogation.

Based on the AEMC’s consultant’s analysis and stakeholder feedback, the Commission believes the regulatory framework does not create a barrier to financing TransGrid or ElectraNet's current share of actionable ISP projects and the application of a different set of Rules to these is not warranted.

The National Electricity Amendment (Participation Derogation- Financeability of ISP Projects (Transgrid)) Rule 2021 and the National Electricity Amendment (Participation Derogation- Financeability  of ISP Projects (ElectraNet)) Rule 2021 have been assessed by the Office of Best Practice Regulation as compliant with requirements for a Council of Australian Governments Consultation RIS.

The AEMC is accepting submissions on the draft rule determinations until 18 March 2021. Final rules are expected to be published in April 2021.
