Regulation Impact Statement for consultation – Attorney-General’s Department

On 25 October 2021, the Attorney-General released the Privacy Legislation Amendment (Enhancing Online Privacy and Other Measures) Bill 2021 (Online Privacy Bill) for consultation.

The Online Privacy Bill will give effect to the Australian Government’s commitment to strengthen the Privacy Act 1988. It enables the introduction of a binding Online Privacy code for social media and certain other online platforms, and increases penalties and enforcement measures. The Online Privacy code will provide Australians with better access to information about, and control of, how these platforms collect, use and disclose their personal information, and will strengthen protections for children and vulnerable persons.

The Attorney-General’s Department is currently consulting on the exposure draft legislation and the draft RIS. Submissions close 6 December 2021. More information on the consultation process, including how to make a submission, can be found here.

Consistent with best practice, the RIS has been certified by the Attorney-General’s Department and was subject to an early assessment by the OBPR.
