National Disability Insurance Scheme (Provider Registration and Practice Standards) Amendment (Consequential Amendment) Rules 2026 

Problem being addressed  

Multiple reviews and inquiries, including the Royal Commission into Violence, Abuse, Neglect and Exploitation of People with Disability, the Independent Review into the National Disability Insurance Scheme (NDIS Review) and the NDIS Provider and Worker Registration Taskforce have revealed serious quality, safeguarding and integrity risks with platform providers and supported independent living (SIL). This includes evidence of risks to quality of care and participants’ safety. The NDIS Quality and Safeguards Commission (NDIS Commission) notes that current regulatory approach for SIL and platform providers have proven inadequate in ensuring proper oversight of these supports.  

Proposal 
The Impact Analysis Equivalent (IAE) considers three policy options. 

  1. Maintain the current voluntary registration process for SIL and platform providers (status quo)  
  2. Implement mandatory registration and registration conditions under existing framework for all SIL and platform providers (preferred option)  
  3. Await design and implementation of future registration reform, such as those proposed by the NDIS Review.

Assessment comments 
The Office of Impact Analysis (OIA) does not assess the quality of reviews and documents used in lieu of an Impact Analysis (IA). IAEs are assessed by OIA for relevance to the recommended option(s) and for the coverage of the seven IA questions.

The OIA assessed that the options analysed in the IAE materials are sufficiently relevant to the proposal. The IAE contains additional analysis prepared by the NDIS Commission, which further addresses all IA questions. 

Regulatory burden 
The NDIS Commission estimates the proposal will increase average regulatory costs by $2.72 million per year, averaged over ten years.
