Problem being addressed
The Transport Safety Investigation Regulations 2003 are due to sunset in October 2021. The Australian Transport Safety Bureau (ATSB) are assessing whether these regulations are operating effectively and efficiently and remain fit for purpose. This includes whether the regulations can be remade without significant amendment.
Proposal
Mr Colin McNamara, Acting Chief Commissioner of the ATSB, has certified that the Transport Safety Investigation Regulations 2003 are operating effectively and efficiently. This has been informed by a consultation process with select industry and stakeholder groups in 2019. Accordingly the regulations can be remade with minor amendments to include requirements for operators of remotely piloted aircraft (RPA) to report transport safety occurrences to the ATSB.

Regulatory burden
The ATSB has assessed that there may be a regulatory burden associated with the requirement for RPA operators to report transport safety occurrences to the ATSB. This has been quantified using the Australian Government’s Regulatory Burden Measurement framework as an additional regulatory burden of $1,908.80 in the first year. Subject to advances in technology and the potential for expanded RPA usage, it is reasonably expected that this will double every three years.
