A New Tax System (Luxury Car Tax) Regulations 2019

Remaking of sunsetting instrument without significant amendments – Department of the Treasury

On 5 September 2019, the Governor‑General remade with only minor amendments the A New Tax System (Luxury Car Tax) Regulations 2000, which were due to sunset on 1 October 2019. The newly remade A New Tax System (Luxury Car Tax) Regulations 2019 are scheduled to sunset on 1 October 2029.

The Regulations support the operation of the luxury car tax by:

  • defining when a vehicle is an ‘emergency vehicle’, which are exempt from the luxury car tax; and
  • defining the term ‘refund eligible car’, as part of the arrangements which provide for a refund of luxury car tax for certain cars used in primary production and tourism industries.

Consistent with Government’s best practice regulation requirements for sunsetting instruments, the Treasury has, after consultation with stakeholders, assessed the instrument as operating effectively and efficiently. Therefore, a Regulation Impact Statement is not required for remaking this instrument.
