On 4 September 2017, the Minister for Education and Training, under subsection 33(1) of the Education Services for Overseas Students Act 2000 (ESOS Act), made the National Code of Practice for Providers of Education and Training to Overseas Students 2018

The National Code sets nationally consistent standards and procedures for registered providers and for persons who deliver education services on behalf of registered providers. Key changes made in the 2018 revision to the Code seek to better support students by:

  • addressing the particular vulnerabilities international students face in terms of safety and welfare, especially for those under 18 years of age;
  • improving the information provided to international students before and at the time of enrolment; and
  • reducing the administrative burden in relation to the process for assessing student transfers; and
  • streamlining course attendance requirements.

The Department of Education was compliant with the Government’s RIS requirements and the level of analysis in the RIS was assessed as consistent with best practice by the Office of Best Practice Regulation (OBPR). The Department of Education estimated the new code will reduce regulatory costs by $2.2 million a year. The OBPR has agreed to this estimate.
