Remaking of sunsetting instrument without amendments – Department of the Treasury

On 3 September 2015 the Department of the Treasury remade one sunsetting legislative instrument without significant amendments: the Income Tax Regulations 1936. The Regulation prescribes how certain parts of the Income Tax Assessment Act 1936 are to be implemented, including determining the amount of the tax rebate available for seniors and pensioners, and those Australian Defence Force (ADF) operations for which the pay and allowances of members of the ADF are exempt from income tax. In line with the Australian Government best practice regulation requirements for sunsetting legislative instruments, the Treasury has assessed the operation of this instrument in consultation with affected stakeholders and has certified that the instrument is operating efficiently and effectively. Therefore the Office of Best Practice Regulation notes that a Regulation Impact Statement is not required for the Regulations to be remade. As the instrument was remade without amendments there are no compliance cost changes.
