Post–implementation Review – Department of the Environment

In June 2010, the then Government amended regulations to extend the safety and quality requirements of installations of small-scale renewable energy generation systems under the Renewable Energy Target (RET) scheme. The Office of Best Practice Regulation (OBPR) identified that the then Department of Climate Change and Energy Efficiency (DCCEE) did not prepare a Regulation Impact Statement (RIS) for this policy prior to decisions being announced by the then Government. Consequently, DCCEE was found non-compliant with the requirements and therefore was required to undertake a Post-Implementation Review (PIR). After responsibility for the RET was transferred to the Department of Industry, Innovation, Climate Change Science, Research and Tertiary Education (DIICCSRTE) in March 2013, the PIR was completed by DIICCSRTE in June 2013, and was assessed as compliant by the OBPR. The PIR was updated in December 2014 by the Department of the Environment, after responsibility for the RET was transferred to Environment in September 2013. The Post Implementation Review (PIR) found that the amended regulations are likely to have contributed toward the tightening the relevant safety, quality and compliance pre-requisites under the small-scale component of the RET scheme.
